Victoria Square Stage Two Customer Referral Promotion – Terms and Conditions.

3. Participants(a) Referrer who:
i. has enter into a Qualifying Contract of Sale or settled on Lots located in Victoria Square; and
ii. referred a New Customer enter into a Qualifying Contract of Sale during the Promotion Period for Lots located in Victoria Square Stage 2.

(b) New Customer who:
i. are not clients of any other real estate agents who have introduced the purchaser to the Project; and
iii. referred by the Referrer enter into a Qualifying Contract of Sale during the Promotion Period for Lots located in Victoria Square Stage 2.

(c) Where the participant is an individual or multiple individuals:
i. each individual must be 18 years of age;
ii. each of the individual must be a person who is lawfully entitled to reside in Australia permanently.
4. DefinitionsLot refers to the property that is subject of the Qualifying Contract of Sale.
 
New Customer refers to an individual referred by the participant to Victoria Square Stage 2
 
Promotion Period means the period commencing 9.00 am AEST on 04 May 2022 and ending on 5.00 pm AEST on 31 May 2022.
 
Victoria Square Stage 2 refers to Victoria Square, Towers 1 (VS03) and 2 (VS04), 2-6 Hallestein Street, Footscray Victoria.
 
Qualifying Contract of Sale means a contract of sale duly exchanged between the vendor and the participant which:
(a) is unconditional and the purchaser has not exercised any right to cool off;

(b) for a purchase of a lot in Victoria Square Stage 2; and

(c) the purchaser has paid the 10% deposit in clear funds.
5. Incentive(a) Subject to the Participants complying with the terms set out in this document, the Promoter will facilitate a rebate of $10,000 to the Referrer from the Vendor. The Participants must comply with the Vendor’s reasonable requirements including but not limiting to entering into any agreement reasonably required by the Vendor to give effect to this incentive.
6. Limitation on Incentives(a) There is only one Incentive available for each contract of sale. Where a participant is a multiple person participant, then the Incentive will be offered jointly to all such persons.
 
(b) Where the New Customer:
i. at the start of the Promotion Period, have accepted or exchanged contract of sale for a Lot; and
ii. during the Promotional Period, cancel or terminate such contract of sale
Referrer are not eligible to receive an Incentive.

(c) This Incentive is not available in conjunction with any other offer.
7. Eligibility(a) The New Customer must :
i. be an individual who is not currently on the Promoter’s customer enquiry database;
ii. not have previously been referred by another person or agent during the promotion period;
iii. not clients of any clients of any other real estate agents who have introduced the purchaser to the Project;
iv. enter into a Qualifying Contract of Sale during the Promotion Period for Lots located in Victoria Square Stage 2;
v. not be in default under the Qualifying Contract of Sale;
vi. settle the Qualifying Contract of Sale by the settlement date stipulated in the said contract.

(b) The Referrer may be a referrer in respect of more than one Lot during the Promotion Period;

(c) The Referrer must comply with all privacy laws and regulations and seek the express approval of the New Customer before referring referral details to the Promoter;

(d) All taxes which may be payable as a consequence of receiving an Incentive are the sole responsibility of each participant.
8. PaymentThe Incentive will be paid within 60 days of the New Customer settling the contract of sale.
9. Privacy and collection notice(a) The Promoter will collect and use each participant’s personal information for the purposes of :
i. Conducting the Promotion, making public statements and advertisements in relation to the Promotion;
ii. Provide the participant’s information to third parties and related entities of the Promoter for the purposes of providing information to the participant about products and services provided by the Promoter and its related entities;
iii. Research
 
(b) The participant consents to the use of their personal information as set out in item 11(a).
10. MarketingEach participant agrees to participate, cooperate, as required, in all publicity activities relating to the Promotion, including, without limitation, being interviewed, photographed, filmed and recorded. Each participant authorises the Promoter to use such content for advertising and publicity purposes in any media worldwide.
